What makes a cruise "overnight"?

Default What makes a cruise "overnight"?

When the SOLAS act says the DQ cannot carry more than 49 "overnight" passengers, exactly what does this mean?

For instance, if the boat were to tie up at a landing at, say 10 or 11 PM and not depart until 5 or 6 AM, does that remove her from the overnight cruising category since she's not moving and with her stage set on the shore, does that provide an extra degree of fire protection?

Would this allow the cruises to be considered non-overnight and therefore, not subject to the restrictions of SOLAS?
