I believe the big difference in what the Delta Queen is doing now and your proposal of cruising during the day is a matter of jurisdiction. The Delta Queen no longer has a COI and is not overseen by the USCG in any manner. She is governed by the local Fire Marshal as any other hotel would be (I think). In order to cruise, she would have to be given a COI which under current law would only allow 49 overnight passengers.
